The State Council's 2026 Regulation on Exit-Entry Administration, Article 5, sets out an exhaustive list of grounds on which a foreign national is refused entry: (1) providing false material or making a false statement when applying for a Chinese visa or at a port of entry; (2) having received a criminal penalty in China for a border-management offense (e.g. document fraud, illegal entry or exit), or an administrative penalty for fraudulently obtaining travel documents or illegal entry/exit; and (3) appearing on China's counter-sanctions list, unreliable-entity list, or malicious-entity list. Categories (1) and (2) carry a 1-to-5-year bar on re-entry. The regulation does not use a general foreign criminal-conviction standard, a sentence-length threshold, or named categories such as drug convictions, DUI, or moral turpitude.
